For purposes of these Business Account Terms, “HailGeeks,” “we,” “us,” and “our” mean Northern Infinity Group, LLC, doing business as HailGeeks.
These Business Account Terms (“Business Terms”) apply to each registered business account and to the business-only features made available through HailGeeks, including, as applicable, interactive hail maps, extended reports, dashboards, account-only tools, report and credit tools, bulk report tools, developer and API tools, alert subscription management tools, directory listing applications, directory listing management tools, business profiles, and related business-facing features (collectively, the “Business Services”).
These Business Terms are incorporated into and supplement the Website Terms of Use. If there is a conflict between these Business Terms and the Website Terms of Use, these Business Terms control with respect to the Business Services.
Certain Business Services may also be subject to the Paid Services Terms. If there is a conflict between these Business Terms and the Paid Services Terms with respect to any paid feature, paid listing, subscription, credit-funded service, or other paid service, the Paid Services Terms control for that paid feature or service.
By creating, accessing, managing, or using a business account or other Business Services, you agree to these Business Terms.
1. Scope of Business Services
Business Services may include, without limitation:
- a. registered business account access;
- b. approved access to interactive hail maps, extended reports, dashboards, and other account-only tools;
- c. business-only data access, search tools, filters, or related platform functionality;
- d. account tools for purchasing and managing report credits, requesting reports, submitting bulk report jobs, and reviewing credit and billing activity, where made available to your account;
- e. developer and API tools, including sandbox and production API access, where made available to your account;
- f. alert subscription management tools, where made available to your account;
- g. for eligible contractors, restoration companies, and other business categories approved by us, the ability to apply to create, claim, submit, manage, or update a directory listing or business profile; and
- h. other business-facing features that we may make available from time to time.
Not all Business Services are available to every account. Access may depend on account type, business category, verification status, approved region, eligibility status, contractor status, listing approval status, paid status, feature availability, or other criteria we establish from time to time.
2. Eligibility and Authority
To open or use a business account, you represent and warrant that:
- a. you are at least eighteen (18) years old;
- b. you are not currently prohibited from using the platform and have not previously had access removed for misuse, unless we expressly permit otherwise;
- c. your use of the Business Services will comply with applicable law;
- d. if the account is connected to a company, organization, or other business, you have authority to act for and bind that business; and
- e. you are using the Business Services only for legitimate business purposes and not for personal, family, or household purposes.
Creating a business account does not guarantee eligibility for every Business Service. In particular, not every business account is eligible to submit, maintain, publish, claim, or purchase a directory listing or other paid feature, and not every business account is eligible for production API access.
2A. Credits, Reports, API Access, and Paid Alert Services
Where your account is permitted to purchase report credits, request reports, submit bulk report jobs, use API access, or enroll in paid alert services, those services are Paid Services governed by the Paid Services Terms, including the provisions of the Paid Services Terms addressing credit treatment, credit-funded charges, refunds, renewals, and cancellation.
Production API access may require a separate application, review, and approval process, and may be granted, limited, conditioned, suspended, or revoked in our sole discretion. Sandbox or test environments, where offered, are provided for evaluation and integration testing only and produce test outputs that have no monetary or commercial value. All API access is also governed by the Developer API Terms.
2B. Customer and Property Data Responsibility
When you submit property addresses, parcel or geographic information, customer references, contact information, bulk files, or information relating to another person through the Business Services, you represent and warrant that you have the lawful right and appropriate authority to submit and process that information through the Business Services, and that your submission and use of that information does not violate any privacy, confidentiality, data-protection, contractual, or other applicable obligation.
You agree to:
- a. use information obtained through the Business Services, including reports, exports, and API outputs, only for legitimate business purposes;
- b. use reasonable safeguards to protect downloaded reports, exports, customer data, and other information obtained through the Business Services from unauthorized access, use, or disclosure;
- c. avoid submitting sensitive personal information that is not necessary for the requested service; and
- d. comply with applicable privacy, confidentiality, and data-protection obligations in connection with your use of the Business Services.
3. Registration, Verification, and Approval
You must provide registration details that are truthful, complete, current, and not misleading, and you must update them as needed.
Business registrations are subject to review before business-only access is granted. Without limiting our discretion or disclosing internal review procedures, we may review or verify business identity, business legitimacy, account information, service categories, region eligibility, listing completeness, supporting materials, or other approval-related factors.
We may refuse registration, deny access, require verification, request supporting information, limit access, suspend an account, or terminate an account if we believe any submitted information is inaccurate, incomplete, misleading, fraudulent, unlawful, or otherwise inconsistent with these Business Terms or the intended purpose of the Business Services.
A business account may be registered for access to account-only maps, reports, dashboards, and similar tools without creating or obtaining a directory listing.
Any request to create, claim, submit, publish, manage, or update a directory listing may require additional information, additional review, category qualification, verification, supporting documentation, or approval.
4. Free Business Account Access
Approved business accounts may receive access to certain free Business Services, including interactive hail maps and related account-only tools for the approved region or regions we make available to that account.
This free access is not a trial and does not require the business to make a later purchase. Approval for a business account or access to any free Business Service does not create any obligation to purchase any paid service, directory placement, credit pack, or subscription.
Free business access does not include a directory listing, enhanced placement, featured visibility, purchased report credits, or any other paid feature unless separately approved and purchased.
Free Business Services may continue on an ongoing basis, subject to platform rules, account standing, continued eligibility, feature availability, and our right to suspend, limit, modify, or discontinue Business Services under these Terms.
5. Account Security and Authorized Use
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Business accounts are intended only for the account holder and its permitted users within the business. You may not share credentials with unauthorized persons or outside parties.
Where API credentials are issued to your account, you are also responsible for maintaining the confidentiality of those API credentials and for all activity conducted with them.
You must promptly notify us if you suspect unauthorized use of your account, compromise of your API credentials, or any other security incident affecting your account.
5A. Organization and Team Accounts
Where a business account is associated with an organization or company workspace, the organization owner and other users with authorized administrative permissions may invite, approve, manage, suspend, or remove team members and may assign or change roles and permissions, subject to the controls we make available.
The organization is responsible for selecting its authorized users, assigning appropriate permissions, promptly removing access when it is no longer required, and ensuring that its users comply with these Business Terms and all other applicable terms. Actions taken by an authorized user within the scope of that user's apparent or assigned authority may be treated as actions of the organization, including requests, purchases, Credit usage, report generation, API activity, listing changes, and subscription-management actions.
Authorized users may be able to access organization information, reports, billing and Credit records, listings, customer references, uploaded files, support communications, API information, and other data made available within the organization workspace according to their roles and permissions. An individual who leaves or is removed from an organization may lose access to the organization workspace, while business records and content associated with the organization may remain under the organization's control and subject to our retention obligations and Privacy Policy.
Each user must use an individual account and must not share login credentials. The organization must notify us promptly if it believes an unauthorized person has obtained access to its workspace or data.
6. Account Types and Feature Eligibility
A business account may provide access to account-only maps, extended reports, dashboards, or other business-facing tools even if the account does not have a published directory listing.
Only contractors, restoration companies, or other business categories that we determine are eligible may apply to create, claim, submit, or manage a directory listing or business profile.
We may determine, in our sole discretion, whether an account or business category is eligible for listing-related features, listing publication, profile management tools, or related directory visibility.
An account that is permitted to access business-only maps or reports is not automatically entitled to create, claim, submit, publish, or purchase a directory listing.
7. Interactive Maps, Extended Reports, and Business Tools
Business accounts may be used to access interactive hail maps, extended reports, dashboards, and related business tools made available through the platform.
Such Business Services are provided only for legitimate business use and subject to all restrictions in the Website Terms of Use and these Business Terms.
Unless we expressly permit otherwise in writing, you may not resell, redistribute, republish, sublicense, commercially exploit, or provide unauthorized third-party access to account-only maps, reports, exports, API outputs, or other Business Services.
We may establish or change feature limits, access limits, geographic limits, download limits, usage limits, rate limits, or other operational controls for account-only Business Services at any time.
8. Directory Listing Eligibility and Submission
If you are permitted to apply to create, claim, or submit a directory listing or business profile, you represent and warrant that:
- a. all information you submit is accurate and not misleading;
- b. you have the right to provide the information, logos, images, ratings information, review summaries, and other materials included in the profile;
- c. your business is authorized to offer the services you advertise;
- d. your listing complies with applicable law; and
- e. your listing does not infringe any third-party rights.
You are solely responsible for your listing and for any services you provide to consumers or other third parties.
To be considered for a directory placement, you may be required to complete the full listing submission or claim process and provide all information, materials, and supporting documentation we request.
Submission of a listing application, listing content, or business profile information does not guarantee approval, publication, activation, continued display, or any particular access to directory-related features. Submission also does not guarantee the right to purchase a paid listing or paid placement.
9. Listing Review, Approval, and Invitation to Purchase
We may review, approve, reject, delay, limit, condition, or remove any listing application, business profile, or listing-related submission in our sole discretion.
We may require supporting information, documentation, business-category qualification, verification, correction of submitted materials, or other onboarding steps before a listing is approved or published.
Approval is discretionary. We may approve, deny, delay, suspend, or revoke directory eligibility, listing access, or related Business Services if a business does not satisfy platform requirements, provides inaccurate or incomplete information, fails verification, violates platform rules, or otherwise no longer qualifies for the applicable service.
If we approve a business or listing for directory participation and the applicable listing or visibility feature requires payment, we may invite you to proceed through the customer paid portal or other purchase process we make available and provide the applicable instructions, individual offer, and related subscription materials.
Approval of a listing application does not, by itself, entitle you to publication, enhanced visibility, paid placement, or other paid benefits.
10. Business Placement, Paid Activation, Visibility, and Ranking
If a listing, business profile, visibility feature, or related directory functionality requires payment, the applicable paid feature will not be activated, published, enhanced, or otherwise made available unless and until:
- a. the listing or profile has been approved;
- b. you have accepted the Paid Services Terms; and
- c. all required fees have been successfully paid.
Paid directory placement (“Business Placement”) is available only to approved businesses. The applicable Business Placement offer is presented individually to the approved business after review. As of the Effective Date, recurring Business Placement pricing is determined by the business category applicable to the approved listing. We may introduce offers that also take account of service area, location, placement type, account requirements, included services, or other disclosed offer factors, but any such factor and the resulting price will apply only when identified in the individual quote, offer, or other purchase materials presented to the business before payment is authorized. Before payment is authorized, the business will receive the complete applicable pricing, including any activation fee, the recurring price, the billing interval, the included services, the renewal terms, and the cancellation conditions.
Business Placement options may include a standard directory listing, enhanced or featured visibility, or other placement options, in each case as described in the individual quote or other purchase materials applicable to the offer.
A standard directory listing allows the approved business to appear in the business directory for the approved region or regions, subject to our platform rules and display criteria. Except for enhanced visibility features expressly included in the applicable offer, standard directory listings are displayed and ranked using HailGeeks’ standard ranking criteria, and payment for a standard listing does not by itself guarantee higher ranking than other standard listings.
Where an offer includes enhanced or featured visibility, the placement provides the enhanced visibility or more prominent display described in the applicable quote or purchase materials. Enhanced visibility details may vary by region, page type, offering, or other purchase-specific materials made available for the applicable paid service.
Where applicable, activation of a paid listing or paid visibility feature may require final setup and may take additional processing time after successful purchase and approval. Billing, renewal, cancellation, activation timing, refund treatment, support channels, and other paid-service terms are governed by the Paid Services Terms and the applicable purchase materials presented at checkout or otherwise made available for the paid service.
11. No Guarantee of Listing Performance
A listing or business profile on HailGeeks does not guarantee:
- a. inclusion in every search result;
- b. any particular ranking, placement, prominence, or visibility;
- c. any specific number of impressions, views, clicks, calls, leads, appointments, or jobs;
- d. any conversion, contract, or revenue outcome; or
- e. uninterrupted display or availability of the listing.
We may determine, in our sole discretion, how listings are categorized, sorted, ranked, filtered, displayed, limited, highlighted, hidden, suspended, or removed.
We may use region, relevance, completeness, service categories, review information, profile quality, business profile score, availability signals, business status, user behavior, technical factors, platform quality signals, featured status, or other criteria when operating the Business Services.
12. Listing Standards and Platform Controls
We reserve the right to edit formatting, standardize presentation, correct obvious errors, request supporting information, and remove, limit, suspend, or terminate incomplete, stale, inaccurate, unlawful, harmful, deceptive, or otherwise inappropriate listings or business profiles.
Businesses may not publish false credentials, deceptive claims, manipulated review presentations, inaccurate service information, or any other content likely to create a misleading impression.
We may distinguish between pending, approved, unpublished, active, inactive, paid, unpaid, suspended, expired, canceled, or other operational listing states as part of our platform management.
13. License to Listing Materials and Business Content
As between you and us, you retain ownership of your business content, subject to the rights granted under these Business Terms.
By submitting, posting, uploading, transmitting, or otherwise providing business content, profile materials, logos, images, descriptions, contact information, review summaries, ratings information, or related materials through the Business Services, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable right and license to host, store, cache, reproduce, adapt, format, publish, distribute, publicly display, and otherwise use that content as reasonably necessary to:
- a. operate and provide the Business Services;
- b. review, verify, process, publish, display, and distribute listings and related profile content;
- c. improve, maintain, promote, and secure the platform; and
- d. enforce our terms, policies, and platform rules.
You represent and warrant that you have all rights necessary to grant this license.
14. Ratings, Reviews, Awards, and Third-Party Business Information
The Business Services may display ratings, review summaries, awards, badges, availability indicators, service categories, profile details, or business-related information obtained from you, public sources, third-party sources, or automated processes.
We do not guarantee that any such information is accurate, complete, current, unbiased, verified, or error-free.
Unless we expressly state otherwise, HailGeeks does not endorse, guarantee, certify, insure, or warrant any business account holder or listed business.
HailGeeks charges only for its own digital services, including reports, report credits, alerts, API services, and Business Placement services. HailGeeks does not collect, hold, transmit, or process payments between property owners and listed contractors and does not act as a payment facilitator, marketplace payment intermediary, or escrow provider for contractor services.
15. Business Use Rules
You agree not to:
- a. use a business account in violation of applicable law;
- b. submit false, deceptive, infringing, or unlawful business content;
- c. misuse maps, reports, dashboards, messaging, lead, contact, listing, profile, credit, bulk, API, or alert tools;
- d. attempt to manipulate rankings, badges, reviews, service areas, listing visibility, or profile visibility through dishonest means;
- e. use the Business Services to impersonate another company or misrepresent your authority;
- f. share account access or API credentials outside the authorized business;
- g. scrape, export, republish, redistribute, resell, or otherwise exploit account-only maps, reports, API outputs, or business-only tools except as expressly permitted by us in writing; or
- h. use business-only features outside their intended operational purpose.
16. Suspension and Termination
We may suspend, restrict, disable, or terminate your business account, access to maps or reports, credit-funded services, API access, alert services, directory eligibility, listing submission rights, or any pending, approved, unpublished, active, or paid listing or profile, or access to any Business Services, with or without notice, if:
- a. you violate these Business Terms, the Website Terms of Use, or the Paid Services Terms, where applicable;
- b. your payment is overdue or invalid, where applicable;
- c. your information is inaccurate, misleading, unlawful, or incomplete;
- d. your conduct creates risk, liability, reputational harm, fraud risk, or technical harm to us, users, or third parties;
- e. you fail verification or no longer satisfy platform requirements or eligibility requirements; or
- f. we determine that suspension or termination is necessary to protect the integrity, security, or operation of the platform.
Termination or suspension does not limit any other rights or remedies available to us.
17. Changes to Business Services
We may add, remove, modify, pause, reorder, limit, or discontinue any business feature, dashboard function, map feature, report feature, credit feature, API feature, alert feature, access rule, listing field, display rule, service category, listing-eligibility rule, or related Business Service at any time.
18. Survival and General Terms
Any provision of these Business Terms that by its nature should survive termination or expiration shall survive, including provisions relating to licenses, disclaimers, limitations of liability, indemnification, payment obligations where applicable, and dispute resolution.
Except as expressly modified by these Business Terms, the Website Terms of Use remain in full force and effect.
If you purchase or use any paid feature, paid listing, paid visibility option, subscription, credit pack, credit-funded service, or other paid service, the Paid Services Terms also apply.
