In the event of a conflict, the more specific terms control with respect to the applicable service or feature.
1. Scope of Website Use
The Website may include, without limitation:
- a. public hail maps, storm maps, weather-related overlays, reports, alerts, storm-event details, and related informational content;
- b. search tools, location-based tools, parcel or property-related lookup tools, and similar public-facing functionality;
- c. public business directory pages and related business profile content;
- d. email-based hail alert subscription features, where offered; and
- e. related website content, communications, and functionality.
The Website is provided for general informational and business-directory purposes only.
Most public areas of the Website may be accessed without creating an account. Certain business-only tools, interactive features, extended reports, account functions, listing functions, API features, and paid features may require a registered business account, review or verification, listing approval, payment, or acceptance of additional terms.

The public informational portions of the Website are intended for a general audience. However, you must be at least eighteen (18) years old to create a business account, submit listing information, purchase a paid feature, or otherwise use any business-only or paid portion of the platform.

Business Services and Paid Services are currently offered only to eligible businesses located in, or authorized to operate in, the United States and for supported United States service areas. You may not access or use the Website or any Service in violation of applicable sanctions, export-control laws, or restrictions imposed by the United States government, and you represent that you are not located in, organized under the laws of, or ordinarily resident in any jurisdiction subject to comprehensive U.S. sanctions and are not on any U.S. government restricted-party list.

Weather and hail information made available through the Website is provided solely as a general informational tool.
You acknowledge and agree that:
- a. weather reporting, storm-event displays, hail paths, impact areas, report locations, severity markers, timestamps, and related outputs may be delayed, approximate, incomplete, or inaccurate;
- b. maps, overlays, event markers, timing information, parcel references, geolocation outputs, and property-related tools are not guaranteed statements of actual conditions, actual damage, legal property boundaries, or exact property matches;
- c. some Website features depend on third-party feeds, mapping systems, public reports, data vendors, communications providers, or other outside systems that may contain errors, delays, outages, or limitations;
- d. independent verification is your responsibility; and
- e. if the Website uses labels such as “Live” or “Near Real-Time,” those labels describe information as processed and made available through our systems and do not mean instantaneous, uninterrupted, complete, or error-free updates.

No content on the Website creates any contractor-client, inspector-client, engineer-client, attorney-client, insurer-insured, fiduciary, or other professional relationship between you and HailGeeks.

HailGeeks does not perform, supervise, direct, warrant, or guarantee the inspection or professional service, is not a party to the engagement between you and the participating business, and is not responsible for that business's statements, availability, qualifications, advice, findings, work, fees, or conduct. Any terms, communications, payment, performance, complaint, or dispute relating to that service are solely between you and the participating business unless HailGeeks expressly agrees otherwise in a separate writing.
HailGeeks charges only for its own digital services, including reports, report credits, alerts, API services, and Business Placement services. HailGeeks does not collect, hold, transmit, or process payments between property owners and listed contractors and does not act as a payment facilitator, marketplace payment intermediary, or escrow provider for contractor services.
6. Acceptable Use
You agree not to, directly or indirectly:
- a. use the Website for any unlawful, deceptive, fraudulent, abusive, harmful, or unauthorized purpose;
- b. scrape, crawl, spider, harvest, mirror, download, extract, copy, or systematically collect maps, reports, listings, profile information, user data, or other Website content by automated means without our prior written consent, except through any documented API we make available, used with valid credentials issued to your account and in accordance with the applicable API documentation, the Business Account Terms, and the Paid Services Terms;
- c. interfere with or disrupt the Website, servers, networks, or security features;
- d. attempt to gain unauthorized access to systems, accounts, data, or related infrastructure;
- e. upload or transmit malware, malicious code, spyware, ransomware, corrupted files, or other harmful material;
- f. impersonate any person or entity or misrepresent your affiliation with any person or entity;
- g. submit false, misleading, infringing, threatening, harassing, defamatory, obscene, discriminatory, unlawful, or otherwise objectionable content through any part of the Website;

- k. use the Website or its contents to create, support, train, benchmark, or improve a competing product, service, directory, or dataset.
7. Intellectual Property
The Website, including its design, layout, software, code, databases, compilations, maps, reports, text, graphics, logos, branding, visual elements, interface elements, directory structure, and related materials, is owned by us or our licensors and is protected by applicable intellectual property and other laws.
Except as expressly permitted in writing, you may not copy, reproduce, modify, distribute, republish, display, license, sell, create derivative works from, or otherwise exploit any portion of the Website.
Content that we expressly designate for sharing under the Open Hail Maps program or another stated sharing permission may be used and shared only in the form, manner, and scope described with that content. You must preserve all required HailGeeks attribution, source labels, disclaimers, branding, copyright notices, and links; you may not imply that HailGeeks, NOAA, the National Weather Service, or another source endorses you or your use; and you may not sell, sublicense, materially alter, or incorporate the content into a competing product, service, directory, or dataset unless the applicable permission expressly allows it. We may change or withdraw a sharing designation prospectively, but a prospective change does not retroactively make a use unlawful if it was completed in compliance with the permission applicable at the time.
All rights not expressly granted are reserved.
8. Third-Party Links and Services
The Website may contain links to third-party websites, social media pages, tools, maps, payment processors, vendors, or other services. We do not control and are not responsible for third-party content, services, practices, terms, or privacy policies.

- d. ANY THIRD-PARTY DATA, FEED, MAP, TOOL, OR SERVICE AVAILABLE THROUGH OR RELIED ON BY THE WEBSITE WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE; OR

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAILGEEKS AND ITS AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, CONTRACTS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE WEBSITE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless HailGeeks and its affiliates, owners, members, managers, officers, employees, agents, contractors, licensors, and service providers from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or relating to your use of the Website, your content, your violation of these Website Terms, or your violation of any law or third-party right.
13. Governing Law; Dispute Resolution
These Website Terms and any dispute arising out of or relating to the Website or these Website Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.
Before filing any formal claim, the parties agree to make a good-faith effort to resolve the dispute informally.
Except for claims that may properly be brought in small claims court, any dispute, claim, or controversy arising out of or relating to these Website Terms or the Website shall be resolved by binding arbitration in Ramsey County, Minnesota, unless the parties agree otherwise, administered by the American Arbitration Association under the applicable AAA rules in effect at the time the claim is filed.
To the fullest extent permitted by law, disputes shall be resolved only on an individual basis. Class actions, class arbitrations, and representative actions are not permitted. Each party waives any right to a jury trial.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect its rights pending arbitration.

We may modify, suspend, discontinue, add, remove, or update any part of the Website at any time, with or without notice.
