These Paid Services Terms (“Paid Terms”) apply to any paid listing, upgraded placement, subscription, visibility feature, business plan, premium tool, report credit, prepaid credit pack, hail report, bulk report processing service, API usage, paid alert subscription, or other paid product or service made available by HailGeeks (collectively, the “Paid Services”). For purposes of these Paid Terms, “HailGeeks,” “we,” “us,” and “our” mean Northern Infinity Group, LLC, doing business as HailGeeks.
These Paid Terms are incorporated into and supplement the Website Terms of Use and the Business Account Terms. If there is a conflict between these Paid Terms and the Website Terms of Use or the Business Account Terms, these Paid Terms control with respect to the Paid Services.
The Paid Services are offered only for business use and only to businesses and authorized business representatives. The Paid Services are not offered for personal, family, or household purposes.
By purchasing, activating, renewing, or using any Paid Service, you agree to these Paid Terms and represent and warrant that: (a) you are at least eighteen (18) years old; (b) you are purchasing or using the Paid Services on behalf of a business or other commercial organization; and (c) you have authority to bind that business or organization to these Paid Terms.
1. Paid Service Scope
Paid Services may include paid listings, enhanced profile visibility, upgraded account tools, subscriptions, premium map access, lead-related features, report credits, prepaid credit packs, hail reports, bulk report processing, API access and usage, paid alert subscriptions, or other business-facing paid offerings we make available from time to time.
Paid directory options are offered as Business Placement, which may include a standard directory listing, enhanced or featured visibility, or other placement options, in each case as described in the individual quote or other purchase materials applicable to your offer (see Section 12).
The specific features, billing intervals, pricing, usage limits, included functionality, renewal terms, promotional terms, activation timing, cancellation terms, and plan details for a Paid Service are or will be described in the applicable checkout flow, order form, subscription page, invoice, proposal, service description, or other purchase materials presented to you for that Paid Service.
To the extent any such purchase-specific materials are more specific than these Paid Terms, those purchase-specific materials control for that Paid Service unless a separate signed agreement provides otherwise.
2. B2B Purchase, Account Requirement, and Eligibility
A Paid Service may require an active business account and may be limited to certain business categories, account statuses, service areas, approved listings, or other eligibility criteria that we establish from time to time.
You agree that you will purchase and use Paid Services only in connection with a legitimate business purpose and not for any personal, family, or household purpose.
Eligibility to maintain a business account or access free business-only features does not, by itself, guarantee eligibility to purchase a Paid Service.
Where applicable, a Paid Service may be available only after:
- a. your business account has been approved;
- b. your listing, profile, or directory submission has been reviewed and approved for directory participation; and
- c. you have completed the applicable purchase process.
3. Approval Requirement Before Paid Purchase or Activation
If a Paid Service relates to a directory listing, business profile, featured placement, or other paid visibility feature, submission of a listing, profile, or directory application does not guarantee approval, publication, activation, or the right to purchase that Paid Service.
We may review, approve, reject, delay, limit, condition, suspend, or revoke eligibility for any listing-related or visibility-related Paid Service in our sole discretion.
If we approve a business or listing for directory participation and the applicable feature requires payment, we may invite you to proceed through the customer paid portal or other purchase process we make available and provide the applicable instructions, individual offer, and related subscription materials.
Approval of a listing application or business profile does not, by itself, entitle you to publication, enhanced visibility, featured placement, or other paid benefits unless and until all required Paid Service purchase steps have been completed.
4. Fees, Taxes, and Payment
You agree to pay all fees, processing charges, and other amounts disclosed at the time of purchase. As of the Effective Date, HailGeeks does not add or collect sales tax through its checkout.
Unless a separate written agreement, order form, or published plan states otherwise:
- a. fees are charged in U.S. dollars;
- b. recurring plans renew automatically for successive billing periods unless canceled before renewal;
- c. you authorize us and our third-party payment processors to charge your designated payment method for recurring and one-time charges you incur in connection with the Paid Services;
- d. you must keep your billing information current, complete, and valid;
- e. you remain responsible for any tax, duty, assessment, or government charge that applicable law places directly on you, excluding taxes measured solely by our net income; and
- f. except to the extent prohibited by law or expressly stated otherwise in writing, all payment obligations are non-cancelable during the then-current paid billing period and all amounts paid are non-refundable.
By completing checkout, you expressly authorize the initial charge and any applicable recurring charges clearly disclosed at checkout or in the applicable order materials. You also agree that electronic records of your checkout, acceptance of these Paid Terms, billing authorization, subscription status, invoices, renewal settings, cancellation activity, credit purchases, credit balances, credit reservations, credit usage, and related purchase records may be used to establish the existence and terms of your purchase.
You further represent and warrant that you are authorized to use the payment method provided for the purchase and for any recurring charges authorized in connection with the Paid Services.
5. Checkout Disclosures and Purchase Records
Before you authorize a purchase of or enrollment in a Paid Service, we or our billing platform will present the material purchase terms applicable to that Paid Service, including, where applicable:
- a. the amount due at the time of purchase, in U.S. dollars;
- b. whether the purchase is a one-time purchase or a recurring subscription;
- c. any one-time activation or setup fee;
- d. the recurring amount or the method for determining the recurring amount;
- e. the billing interval;
- f. the renewal date or the method for determining the renewal date;
- g. how cancellation works;
- h. when the service starts, is delivered, or is expected to be activated;
- i. any applicable tax amount that HailGeeks will charge, if HailGeeks later begins collecting tax and applicable law requires it to be displayed; and
- j. the available subscription, placement, or credit pack options, or the individually quoted offer applicable to you.
You agree that your purchase may be completed through a customer paid portal, billing platform, hosted checkout flow, or other purchase process we make available.
6. Service Activation and Fulfillment
Paid Services are digital business services.
Where applicable, activation of a Paid Service, including a paid directory listing, enhanced placement, or paid visibility feature, may require final setup, processing, publication, or platform configuration after successful purchase and approval.
Unless expressly stated otherwise in the applicable purchase materials, activation may take up to two (2) business days after successful purchase and any required approval steps are completed.
Unless expressly stated otherwise in writing or in the applicable purchase materials, the billing term for the Paid Service begins at the time of purchase, even if final setup, publication, or activation takes additional time within the activation window described above.
Report credits purchased through a credit pack are generally added to your account credit balance promptly after the payment is confirmed by our payment processor. Reports, bulk report results, API outputs, and other credit-funded outputs are generally delivered digitally through your account dashboard, available download functionality, or the API, as applicable, when processing completes.
Purchase of a Paid Service does not guarantee immediate publication, immediate ranking, immediate visibility, or uninterrupted availability.
7. Payment Processing
Payments for Paid Services may be collected and processed by one or more third-party payment processors or billing platforms. Your use of those payment-processing services may also be subject to the applicable processor’s or platform’s terms, conditions, billing agreements, recurring payment authorizations, and privacy practices.
We are not responsible for errors caused solely by a third-party payment processor, issuing bank, card network, or payment platform, but you remain responsible for charges validly incurred for Paid Services purchased through your account.
8. Billing Failures, Chargebacks, and Payment Issues
If your payment method fails, expires, is declined, is reversed, is disputed, or cannot be processed for any reason, we may retry payment and may also suspend paid features, remove enhanced visibility, downgrade your plan, restrict account access, or terminate the applicable Paid Services.
You remain responsible for all unpaid charges validly incurred before cancellation, suspension, or termination.
If you believe a charge was made in error, you agree to contact us promptly so that we may review and attempt to resolve the issue. Initiating a chargeback or payment dispute does not automatically cancel your subscription or eliminate your responsibility for valid charges. We may suspend or restrict Paid Services while a chargeback, reversal, or payment dispute is pending.
If a payment funding a credit pack purchase is reversed, disputed, refunded, or otherwise invalidated, we may reverse, remove, or invalidate the corresponding credits, including credits already added to your account balance, and we may suspend credit-funded features while the matter is reviewed.
If you fail to pay amounts when due and we refer the matter for collection or enforcement, you agree to pay our reasonable costs of collection, including reasonable attorneys’ fees and court costs, to the extent permitted by law.
9. Automatic Renewal
If a Paid Service is offered on a recurring subscription basis, it will renew automatically for the next billing period unless you cancel before the applicable renewal date using a cancellation method we make available.
The recurring nature of the subscription, the applicable billing cycle, the recurring amount or method for determining the recurring amount, and the cancellation method made available for that Paid Service will be presented in the applicable checkout flow, order form, subscription page, invoice, proposal, or related purchase materials.
By enrolling in a recurring Paid Service, you authorize recurring charges to your designated payment method, or, where the applicable purchase materials so state, recurring deductions from your account credit balance, in accordance with the terms disclosed at the time of purchase until canceled.
10. Renewal Reminders
Where our billing platform or purchase system provides advance renewal reminders for recurring Paid Services, such reminders may be sent before an upcoming renewal or billing event. Unless otherwise stated in the applicable purchase materials, such reminders may be sent approximately two (2) weeks in advance of the upcoming billing event.
Failure to receive, view, or act upon a reminder does not cancel the subscription and does not eliminate your responsibility for valid recurring charges authorized under these Paid Terms.
11. Promotions, Introductory Pricing, and Discounts
We may offer promotional pricing, discounts, coupon codes, introductory offers, or similar limited-time pricing for certain Paid Services.
Unless expressly stated otherwise in the applicable offer, checkout flow, order form, or related purchase materials:
- a. a promotion or discount applies only for the stated promotional period or billing term;
- b. once the promotional period or discounted term ends, renewal will occur at the regular renewal price or other price expressly disclosed at checkout for the applicable renewal term;
- c. promotional offers may be subject to eligibility limits, usage limits, account limits, service limits, expiration dates, or other conditions; and
- d. we may modify, suspend, or discontinue promotional offers at any time before purchase.
Nothing in this section obligates us to continue any promotional or discounted pricing beyond the expressly stated promotional term.
12. Business Placement, Visibility Options, and Individually Quoted Offers
Paid directory placement (“Business Placement”) is available only to approved businesses. The applicable Business Placement offer is presented individually to the approved business after review. As of the Effective Date, recurring Business Placement pricing is determined by the business category applicable to the approved listing. We may introduce offers that also take account of service area, location, placement type, account requirements, included services, or other disclosed offer factors, but any such factor and the resulting price will apply only when identified in the individual quote, offer, checkout flow, or other purchase materials presented to you before payment is authorized. Before you authorize payment, you will receive the complete applicable pricing, including any activation fee, the recurring price, the billing interval, the included services, the renewal terms, and the cancellation conditions.
Business Placement options may include a standard directory listing, enhanced or featured visibility, or other placement options, in each case as described in the individual quote or other purchase materials applicable to your offer.
A standard directory listing allows the approved business to appear in the business directory for the approved region or regions, subject to our platform rules and display criteria. Except for enhanced visibility features expressly included in your offer, standard listings are displayed using HailGeeks’ standard display criteria, and payment for a standard listing does not by itself guarantee higher ranking than other standard listings.
Where an offer includes enhanced or featured visibility, the placement provides the enhanced visibility or more prominent display described in the applicable quote or purchase materials. Enhanced visibility details may vary by region, page type, offering, or other purchase-specific materials made available for the applicable Paid Service, and no particular position is guaranteed unless expressly stated in your offer.
We may modify page layouts, display locations, presentation methods, or feature arrangements from time to time, provided that the Paid Service generally remains consistent with the applicable purchase materials for the then-current paid term.
13. Report Credits and Credit Packs
Certain Paid Services are paid for using report credits (“Credits”). Credits are prepaid, non-monetary usage units that may be purchased in credit packs at the prices disclosed at the time of purchase and that may be redeemed only for the credit-funded services we designate from time to time, which may include hail reports, bulk report processing, API usage, and paid alert subscriptions.
A credit pack purchase is a one-time purchase and is not a subscription. Purchasing a credit pack does not enroll you in any recurring card charge.
Unless expressly stated otherwise in writing or required by applicable law:
- a. Credits are closed-loop usage units intended solely for purchasing the designated HailGeeks services made available to your business account; they have no cash value, are not money or a deposit account, are not offered as general-purpose stored value or as a gift card, and cannot be redeemed, exchanged, or refunded for cash;
- b. Credits are not transferable, assignable, or resalable and may be used only by the purchasing business account;
- c. Credits do not accrue interest;
- d. the number of Credits required for a particular credit-funded service is disclosed within the platform at or before the time you request that service, and the Credit cost in effect at the time your request is accepted applies to that request, even if standard Credit pricing later changes;
- e. purchased Credits do not expire solely because of the passage of time; they remain available for use while the purchasing business account remains open and in good standing, subject to the account-closure, payment-reversal, suspension, and termination provisions of these Paid Terms; and
- f. Credits may be forfeited upon account closure requested by you after you have been given a reasonable opportunity to use them, or upon suspension or termination of your account or the applicable Paid Services for a material violation of the Website Terms of Use, the Business Account Terms, or these Paid Terms, fraud, abuse, or an invalidated or reversed payment; and
- g. if we permanently discontinue the applicable Credit-funded services or close your account solely for our convenience and not because of your breach, fraud, abuse, payment reversal, legal obligation, or security risk, we will provide a reasonable opportunity to use remaining purchased Credits or an appropriate alternative remedy, subject to applicable law.
When you request a credit-funded service, the applicable number of Credits may be placed on hold (reserved) while the request is processed. If the request completes successfully, the reserved Credits are deducted from your balance. If the request fails or cannot be completed by our systems, the reserved Credits are automatically released back to your account balance. A release of reserved Credits restores your Credit balance and is not a monetary refund.
We may make free, promotional, courtesy, or test Credits available from time to time, including Credits provided in a sandbox, evaluation, or testing environment. Such Credits have no monetary value, are not purchased Credits, may be subject to additional limits or expiration, and may be modified, removed, or invalidated at any time. Any courtesy Credit adjustment issued in one instance does not obligate us to provide the same treatment in another instance.
Your Credit balance, Credit purchases, Credit holds, Credit deductions, and Credit releases are recorded in your account, and those electronic records are authoritative absent demonstrated error.
We may correct a demonstrated or reasonably verified error in a Credit record, including a duplicate or erroneous Credit grant, deduction, release, reservation, reversal, or administrative adjustment. A correction must correspond to the error being corrected, will be recorded in the account Credit ledger, and will not be treated as a discretionary forfeiture of validly purchased Credits. We may request information reasonably needed to investigate a claimed error, and you may contact us if you believe a correction is inaccurate.
14. Hail Reports, Bulk Report Processing, and Report Verification
Credit-funded report services may include individual hail reports of one or more report types and bulk report processing, in which multiple report requests are submitted together and processed row by row.
For bulk report processing, Credits are reserved and charged on a per-request (per-row) basis. Rows that complete successfully are charged; rows that fail or cannot be completed are released as described in Section 13. Completion of some rows in a bulk submission does not guarantee completion of all rows, and partial completion of a bulk submission is not a billing error.
Reports are digital informational records generated from radar-derived data and related platform data as processed and made available through our systems as of the time of generation. A report may include a verification link or verification code that allows a recipient to confirm that the report was generated through the HailGeeks platform and has not been altered. A verification link confirms only the authenticity and platform origin of the report record itself.
Reports, verification links, and related outputs are not an inspection, engineering determination, adjustment, appraisal, certification of damage, insurance determination, legal conclusion, or professional opinion of any kind, and do not guarantee that damage did or did not occur at any property. The Website Terms of Use, including the informational-use provisions and disclaimers, apply to all reports and related outputs.
Reports are delivered digitally through your account dashboard or other delivery method we make available, generally promptly after processing completes.
15. API Access and Usage-Based Charges
Where we make an application programming interface (“API”) available, API access may require an approved business account, separate production-access approval, issuance of API credentials, and acceptance of the Developer API Terms and applicable API documentation.
Unless expressly stated otherwise in the applicable purchase materials or documentation:
- a. API requests that generate reports or other credit-funded outputs are charged in Credits at the rates disclosed within the platform or documentation at or before the time of the request, in the manner described in Section 13;
- b. sandbox or test API environments, where offered, use free test Credits and produce test outputs that have no monetary or commercial value;
- c. you are responsible for maintaining the confidentiality of your API credentials and for all activity conducted with them, and you must notify us promptly of any suspected compromise;
- d. you may not share, resell, sublicense, or transfer API access or API credentials outside the authorized business;
- e. we may impose, change, or enforce rate limits, volume limits, technical requirements, and usage rules; and
- f. we may suspend, restrict, or revoke API credentials or API access at any time for security, abuse, non-payment, eligibility, or platform-protection reasons, or as otherwise permitted under these Paid Terms.
API availability is not guaranteed, and no service-level commitment applies unless set out in a separate signed agreement.
16. Paid Alert Subscriptions and Credit-Funded Renewals
Certain alert or notification services may be offered as paid subscriptions that renew on an annual or other recurring basis and that are paid for by deducting Credits from your account credit balance rather than by charging a payment method directly.
Before you enroll in a credit-funded recurring alert service, we will disclose the number of Credits to be deducted for the initial term and each renewal term, the renewal interval, the next renewal date or method for determining it, the effect of insufficient Credits, and how to disable renewal. Enrollment requires your affirmative authorization of the disclosed recurring Credit deductions and acceptance of the applicable terms. We may retain electronic records of that authorization, including the terms version, acceptance time, Credit cost, renewal interval, and related subscription details.
For any such credit-funded recurring alert service, unless expressly stated otherwise in the applicable purchase or enrollment materials:
- a. the Credit cost per renewal term and the renewal interval are disclosed at or before enrollment;
- b. the service renews automatically at the end of each term by deducting the disclosed number of Credits from your balance, until you disable renewal;
- c. you may disable renewal at any time through the self-service controls in your account dashboard, and disabling renewal does not require contacting us;
- d. where our systems provide renewal reminders, a reminder may be sent before an upcoming renewal, and failure to receive or act on a reminder does not cancel the renewal; and
- e. if your Credit balance is insufficient at the time of renewal, the renewal is not processed, no Credits are deducted, and the alert service may pause, lapse, or be suspended until Credits are available and renewal is completed or re-enabled.
Unless the applicable enrollment materials state otherwise, disabling or canceling a paid alert stops alert delivery when the requested change is processed, disables future renewal, and does not restore or refund Credits for the unused portion of the current alert term. This paragraph controls over the general end-of-period access provision in Section 17 with respect to paid alerts.
17. Cancellation
You may cancel a recurring Paid Service at any time using the cancellation method we make available, including, where applicable, through your account dashboard, customer paid portal, or billing portal. When a portal-based cancellation method is available for the applicable Paid Service, cancellation does not require contacting HailGeeks directly.
Unless expressly stated otherwise in a specific offer, plan, order form, or separate written agreement:
- a. cancellation stops future renewals only;
- b. cancellation does not entitle you to a refund for the current billing period already paid;
- c. your access to the Paid Service, including a standard listing, featured placement, enhanced placement, or premium visibility, may continue through the end of the current paid billing period unless earlier suspended or terminated under these Paid Terms, the Business Account Terms, or the Website Terms of Use;
- d. at the end of the paid billing period, the Paid Service may expire, downgrade, revert to a free tier if one exists, or lose premium features, visibility, or functionality associated with the paid plan; and
- e. any accrued payment obligations survive cancellation.
18. Refunds
Unless expressly stated otherwise in writing or required by law, fees paid for Paid Services are non-refundable. Digital delivery, cancellation mechanics, and the circumstances in which we will review a refund request are further described in the Refund, Cancellation and Digital Delivery Policy, which is incorporated into these Paid Terms.
Without limiting the foregoing, and unless expressly stated otherwise in writing or required by law: fees paid for credit packs are non-refundable; unused Credits are not redeemable or refundable for cash; and the automatic release of reserved Credits for a failed request, as described in Section 13, restores Credits to your balance and is not a monetary refund.
Any exception, credit, courtesy adjustment, discretionary refund, or partial accommodation issued in one instance does not obligate us to provide the same treatment in another instance.
19. No Performance Guarantee
Purchase of a Paid Service does not guarantee any specific business result.
Without limitation, we do not guarantee:
- a. any specific ranking, placement, prominence, or visibility;
- b. any specific number of impressions, views, clicks, calls, leads, appointments, jobs, conversions, contracts, or revenue;
- c. that any user will contact, engage, or hire your business;
- d. that any Paid Service will produce marketing value, commercial value, return on investment, or business opportunity;
- e. that any report, bulk output, API response, or alert will be accurate, complete, current, or suitable for any particular purpose; or
- f. that any Paid Service will be uninterrupted or available at all times.
20. Service Changes and Pricing Changes
We may add, modify, suspend, remove, or discontinue plans, included features, usage limits, eligibility requirements, display rules, service categories, technical functionality, Credit pricing for future requests, or other aspects of the Paid Services at any time.
However, unless expressly disclosed and agreed to in a separate signed agreement or otherwise required by law, we do not use this section to impose a hidden higher renewal price on an already-purchased active subscription term, and we do not use this section to change the Credit cost of a request after that request has been accepted and the applicable Credits reserved. If we change pricing for a future plan, offering, or credit-funded service, the updated pricing will apply prospectively to new purchases, new subscriptions, new billing commitments, new requests, or replacement subscriptions accepted at the updated price.
If you wish to move from an older subscription or plan to a new subscription or plan offered at a different price, you may be required to cancel the existing subscription and purchase the new subscription at the then-current price presented at checkout or in the applicable purchase materials.
If required by applicable law, we will provide notice of material changes to recurring Paid Services in the manner required by law.
21. Support Channels
Where we make available a customer support portal, billing portal, ticket system, or other support channels for Paid Services, you may use those channels for billing, service, or account-related issues.
We may designate particular support channels for particular issues, including billing or subscription-management issues.
22. Suspension and Termination
We may suspend, restrict, disable, downgrade, or terminate any Paid Service, with or without notice, if:
- a. you violate the Website Terms of Use, Business Account Terms, or these Paid Terms;
- b. your payment is overdue, invalid, disputed, reversed, or cannot be processed;
- c. your account or listing information is inaccurate, misleading, unlawful, or incomplete;
- d. your conduct creates risk, liability, reputational harm, fraud risk, or technical harm to us, users, or third parties;
- e. you fail verification or no longer satisfy applicable platform requirements or eligibility requirements; or
- f. we determine the action is necessary to protect the integrity, security, or operation of the platform.
Suspension or termination of a Paid Service does not limit any other rights or remedies available to us and does not relieve you of responsibility for valid charges already incurred.
If we permanently terminate a recurring Paid Service solely for our convenience before the end of a prepaid service period, and not because of your breach, fraud, abuse, nonpayment, payment dispute or reversal, legal obligation, or security risk, we will provide an appropriate prorated refund, service credit, restoration, or comparable remedy for the undelivered portion of that prepaid period, as applicable. This paragraph does not require a refund for service already delivered, a properly canceled renewal, or a suspension or termination permitted for one of the customer-related reasons stated above.
23. No Resale or Unauthorized Transfer
Unless we expressly agree otherwise in writing, Paid Services, including Credits, reports, API access, and API outputs, are licensed or provided only to the purchasing business account holder and may not be resold, sublicensed, assigned, shared outside the authorized business, or transferred to another person or entity except as expressly permitted by us in writing.
24. Order of Precedence; Separate Agreements
If you enter into a separate signed agreement, order form, insertion order, proposal, or other written commercial agreement with us covering a Paid Service, that separate agreement controls to the extent of any direct conflict with these Paid Terms.
If there is no separate signed agreement, the specific terms disclosed at checkout or in the applicable order, invoice, or plan materials control over these Paid Terms to the extent they are more specific to the purchased Paid Service.
25. Survival and General Terms
Any provision of these Paid Terms that by its nature should survive termination or expiration shall survive, including provisions relating to payment obligations, billing authorizations, chargebacks, Credit treatment, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and survival itself.
Except as expressly modified by these Paid Terms, the Website Terms of Use and Business Account Terms remain in full force and effect.
